Under Oregon law, you may be able to recover monies if the other party breached a contract.
The amount of money you will be able to recover depends on your individual circumstance. However, in general, you are able to recover both the amount of money that would put you in the position you would have been in had the other party not breached the contract. For example, if, after you paid a contractor $25,000.00 to perform a kitchen remodel at your home, the price of materials and labor increases such that the contractor would like to increase the price to $35,000.00 or nullify the contract, you could sue the contractor to recover monies. However, you could not force the contractor to perform the work. In this instance, you would likely be able to recover $10,000.00 from the contractor: the price the contractor for which the contractor agreed to perform the work $25,000.00 minus the amount it will cost you to have another contractor perform the work $35,000.00 equals $10,000.00.
If you have suffered from another's breach of contract, you should speak with a expert contract attorney as soon as possible.
