What should I do if my contractor is not repairing the defects?

If your contractor is not repairing the defects, there are several steps you can take to try to resolve the issue:

  1. Review your contract: Check your contract to see what it says about defect repairs. This should outline the contractor's obligations and your rights as the homeowner.

  2. Document the defects: Make a detailed list of the defects you have noticed, take photographs or videos, and keep copies of any relevant documentation or communication with the contractor.

  3. Contact the contractor: Reach out to the contractor and explain the issue. Ask them to come and inspect the defects and provide a timeline for repairs.

  4. Follow up in writing: If the contractor fails to take action, send a written notice of the defects to the contractor, detailing the problems and requesting that they make the necessary repairs.

  5. Consider legal action: If the contractor still refuses to take action, you may want to consider legal action. Consult with an attorney who specializes in construction law to understand your options.

  6. Seek mediation: If you would like to avoid legal action, you can seek mediation with a neutral third-party mediator. Mediation can be an effective way to resolve disputes and come to a mutually beneficial agreement.

Remember, it's usually best to try to resolve issues with your contractor directly before taking legal action or seeking mediation. However, sometimes, you may wish to seek legal action in order to prevent the statute of limitations (which is a deadline) from barring your claims. Regardless, you should keep a record of all communication and be persistent in your efforts to get the defects repaired.
